Keep Calm and Litigate On!
The day for oral arguments finally arrived, as attorneys appeared before the Supreme Court of the United States (SCOTUS) in Washington, D.C. to argue disputed matters in New York State Rifle & Pistol Association v. New York City. At the heart of the matter, it is a challenge to New York City’s firearm transport ban. Both sides—Pro-Second Amendment folks and anti-rights groups like Big Daddy Bloomberg-funded Everytown, Moms Demand and the Brady folks alike, anxiously awaited a long-overdue conversation on the substance of the Second Amendment’s application outside the home.
Disappointing to some, the Court focused on the issue of mootness more than the merits of the Second Amendment’s application outside the home. The issue of mootness seems so academic and theoretical: Well, it is exactly that. Unlike a right to Keep and Bear arms which is tangible and substantive, mootness isn’t very interesting.
You may be asking what is mootness? A case is moot “when the issues presented are no longer alive or the parties lack a legally cognizable interest in the outcome of the lawsuit.” See www.FedBar.Org March/April 2008. Not very exciting, but extremely critical to American jurisprudence.
Left-leaning media are enthusiastically pushing their articles about how the Court does not seem interested in expanding Second Amendment rights after today’s arguments. They think they’ve found an off-ramp for this 2A train barreling down the tracks. I tell them, do not count your chickens before they’ve hatched. If this train car doesn’t get heard on the merits, the Cheeseman case will, or another thereafter.
My pro-Second Amendment folks: do not lose heart. No one knows how the Court will rule. No one knows why a Justice asks a question or remains silent during oral argument. Justice Clarence Thomas asked his first question in three years back in March of 2019 ---that was after ten years of not asking any questions, from 2006 to 2016. I suggest not judging a Justice by his/her questions.
Keep calm and litigate on!

WHY SHOULD A RANGE SHOOTER GET A HUNTING LICENSE?
As I write this, I am sitting in a camouflage tent-like hunting blind in the mountains of "wild and wonderful" West Virginia.
Wouldn't it make sense to avail yourself all of the outdoors New Jersey has to offer?
Hunting is a discipline as is shooting at the range. To get a hunting license, you must study, take a knowledge- based test based on safety, hunting ethics etc. and you must pass with proficiency. Then, once that is achieved, you take the hands-on test to demonstrate your ability to safely handle your choice of hunting device and make ethical shots.
There are 3 main categories of hunting licenses (permits) in New Jersey.
1) shotgun 2) black powder (muzzleloader) 3) archery
You can choose to take the tests for all 3 at once if offered. If you don't have a shotgun, or muzzleloader rifle, they may be available during the test. For archery, you would likely have to bring a bow or maybe a crossbow if allowed. The archery test with a bow takes accuracy so you will need to practice. It's best to check the details, it's all in the study materials.
Many people take all 3 hands-on tests in 1 morning or afternoon. It's really an enjoyable time. You will meet great people as you wait your turn. Many dads and moms with their young sons and daughters will likely be there. Hunter Education is available at age 10, with SAFETY being the primary lesson.
At some time, you may be asked to go on an adventure such as dove, quail, turkey hunting or for pheasant in South Dakota, elk in Colorado etc. You will need a license.
Many states require you to have a prior license or a qualification certificate. If you don't have a license, you will need to wait until classes are available when you are available. This can create a problem. If you already have the hunting certificates or a license, you're in! Book that flight or get your license and meet your friends to hunt locally.
Getting a hunting certificate and/or license shows your support of the 2nd Amendment as numbers count! Hunting license fees also pay for wildlife and land conservation efforts. Another often overlooked fact is that a $27.50 NJF&W Hunting License buys you all the range time you can handle at the state-run Wildlife Management Areas (WMA's). Several long gun-ONLY ranges are available throughout NJ's 21 counties (check NJ compendium for caliber/gun restrictions and for places where lead birdshot is disallowed!)
NJ Fish & Wildlife also has their "Apprentice" license program in effect again this year. It enables a prospective hunter the ability to go hunting with a mentor, for up to 2 years, without the mandatory classroom training & exam. CNJFO is running a Pheasant Hunt on Leap Year Day, Saturday February 29th, 2020, and is allowing Apprentice Hunters to hunt pheasant. I am a believer that range shooters like learning various disciplines. If you don't have a license yet, consider it a challenge and adventure. You will undoubtedly learn new skills and it really is fun!

CHEESEMAN SOUNDS OFF ON NJ's RED FLAG LAW! DELIBERATE, SEVERE, CALCULATED ATTACK ON GUNS!

New Jersey's Extreme Risk Protection Act would appear to be one of the most severe and calculating versions of the law in the nation. In a very short time period, the legislative, executive and judicial branches of N.J. executed and put into effect this law. The one common and repeated part of the law and directives is REMOVAL of firearms. If we examine the law closer, we find the fundamental flaws.
1) No due process. The 5th amendment states that no one may be deprived of life, liberty or property without due process of law.
2) Presumption of innocence. The presumption of innocence is a cardinal principle of our justice system. It is the prosecution’s burden to prove guilt beyond a reasonable doubt. Yet if we read the guidelines submitted below, we find our Second Amendment rights violated first.
3) Property being confiscated without compensation; a firearm in its most basic form is property. So we also see our 14th Amendment rights violated.
4) And of course, our Second Amendment rights BLATANTLY violated.
Evidence and lack thereof. Hearsay. From Directive # 19-19:
"Evidence. In determining whether to issue a temporary Extreme Risk Protective Order, the Court may examine under oath the Petitioner and any witnesses the Petitioner may produce. The court may consider the sworn oral testimony of a Petitioner or witness who, although not physically present in court, identifies himself or herself, specifies the purpose of the request and discloses the basis of the petition".
This is an example of why this law is dangerous and flawed. A spouse, ex-spouse, family member (other persons) may petition the court for a very wide and broad set of allegations of wrongdoing, based on FEELINGS & EMOTIONS that may not be accurate or even TRUTHFUL!
What we have is a perfect example of "He said / She said" being used as a vehicle to STRIP one of their Second Amendment rights. ANY WITNESS THE PETITONER MAY PRODUCE is allowed to testify. And they DO NOT HAVE TO BE IN COURT TO ACCUSE YOU!
Does your neighbor HATE YOU because your dog craps in their yard? Your kids play the stereo too loud? The vehicles from your growing family take up too many parking spots on the street? Does this neighbor know you have guns? Had he or she witnessed you loading gun cases in a vehicle? A RED FLAG, sworn-out against you WITHOUT the need for PROOF and WITHOUT any REPERCUSSIONS on the Petitioner would "solve a multitude of sins"!
THE TIMELINE OF OUR RIGHTS BEING ERODED:
Extreme Risk Protection Act for New Jersey. ERPO. FAST TRACKED. On 1/9/19 the Extreme Risk Protection Act is introduced into Assembly Law and Public Safety Committee, where most of NJ's unconstitutional laws emerge.
On 6/7/19 both Assembly and Senate vote the bill into law.
On 7/15/19 Attorney General of N.J releases Directive 2019-2 ERPO: https://www.nj.gov/…/newsrelease…/Extreme-Risk_Directive.pdf
On 7/12/19 Glenn A Grant Administrative Director of the Courts releases directives/guidelines to all Assignment Judges and criminal court Judges. Directive #19-19 https://njcourts.gov/notices/2019/n190813a.pdf
In closing it becomes apparent the Bill, law and guidelines were all written for one purpose: CONFISCATION OF FIREARMS! Why do I say that? The Bill, the law and each directive all point to removal of firearms under a very broad and UNCONSTITUTIONAL set of guidelines. We can also see this whole scheme was put into effect very quickly, and frankly, very irresponsibly. The only recourse we have is to get this law into court and struck down as bad law. Are we supposed to stick our heads in the sand? Absolutely not!
I believe we need to be cautious and continue as we would normally. I believe we have the right to express ourselves as law-abiding citizens who will NOT BE INTIMIDATED by fear of speaking our minds and exercising our RIGHTS. I believe we should CHALLENGE the Courts and support those who are challenging the Courts. I believe we need to have each other’s back and offer whatever support we see fit.
Mark Cheeseman, the Petitioner in Cheeseman vs. John Polillo, Chief of Police of Glassboro, NJ, case No. 19-27, is currently seeking CERT (still ON-HOLD(?) pending outcome of NYSR&P case already granted CERT) before the Supreme Court of these United States.
Cheeseman, together with Historian Jay Factor & attorney David Jensen, have undertaken the huge task of expanding weapons carry in Heller to include venues OUTSIDE the home being a constitutionally protected RIGHT! Several years of ongoing lower court battles have brought us to the precipice of getting our rights restored since the scourge of NJ's #JustifiableNeed was forced down our throats. Both Cheeseman and Factor attended last summer's Sporting Clays match held as a fundraiser in their honor. We all yearn for SCOTUS to VOTE 5 Black Robes to NJ CARRY!
RED FLAGS & "AT YOUR OWN PERIL" GUN OWNERSHIP! "THEY CAN'T TAKE OUR GUNS AWAY!": HOLD MY BEER!

Alright my fellow gun peasants, let’s talk about Red Flag laws. The standoff between the Putnam County New York Sheriff’s Department and veteran, Alexander Booth on Saturday night grabbed the attention of Second Amendment advocates and law enforcement alike. Booth was live-streaming tense moments from his Instagram account “whiskey_warrior_556.” Booth warned of an impending Red Flag arrest—he said he was being accused of possessing a 30-round magazine. Meanwhile, law enforcement made reference to prior domestic violence allegations. Both sides said there were no guns present.
We do not know all the underlying facts, but we rarely do. What do we know? We know that Red Flag laws are dangerous for both the citizen and law enforcement. We know that citizens are increasingly mistrusting of their government. We know that politicians who make these laws endanger all of us, while they sit safely behind armed security on the sidelines. We know that this will happen again, and the results may differ. We know that Second Amendment advocates are a sleeping giant who is now restless; feeling provoked, maybe even threatened.
It is becoming increasingly evident that Second Amendment advocates are the ones doing the heavy lifting when it comes to First, Fourth, and Fourteenth Amendment protections. The interconnectedness of the Second Amendment and concepts of free speech, illegal searches, seizures, procedural and substantive due process is at hand, and shown most significantly when so-called Red Flag laws are enforced.
Folks in other states will likely find this unbelievable, but gunowners in New Jersey have been told by our courts that we own a gun “at our own peril.” See State of New Jersey v. Pelletieri, 294 N.J.Super. 330 (1996). The State has demonstrated the truth of this peril by jailing the likes Shaneen Allen, Brian Aitken and countless others. Unfortunately, the peril is increasing, and Second Amendment advocates (not gangsters or violent criminals, of course) are feeling the squeeze. The purpose is to instill fear in law-abiding gun owners. Is it working?
As a Constitutional gunowner, do you realize you are being held to a higher standard than everyone else? Of course, with rights comes great responsibility. We are the most background checked group of citizens in our society. We always know this and we live this. But the stakes are different now. This is about what you say, what you believe, what you think? Did you share a distasteful meme? Hold repulsive beliefs? Offend a political opponent? Melt a snowflake? Hurt someone’s feelings? Bring litigation against someone? Not a nice guy?
Because the Red Flag Laws do not include a penalty for false accusations, or a shifting of costs to an accuser (called the English rule) if the case is not proven, it is prime for widespread abuse. It is easy to light and hurl the Molotov cocktail of an accusation and run, letting law enforcement and the taxpayers do your bidding with no consequence for false accusation. Dragging someone through the legal system is punishment enough, costs and hours lost are just the beginning. Your political enemies will get satisfaction from this. Sounds outrageous or unlikely? Think again.
A man from South Jersey has already filed a case with the federal court, asking it to take action, arguing that New Jersey’s Extreme Risk Protection law is unconstitutional for violation of his civil rights. The individual has been accused of holding and expressing repulsive beliefs, but has not been found to have done anything or threatened anyone.
Remember the peril, and the higher standard: what you think, and what you say. In our Constitutional Republic, know that widely-accepted beliefs, popular, typical, unexceptional expressions do not need the protection of the Constitution from government. It is the culturally objectionable expression, the offensive, unpopular that needs protection. Perhaps we need more lessons on our Republic and the Constitution—our politicians certainly need it.
It is past time for the federal courts to return our rights from the precipice. We gun peasants will lead the way.

Team Apache scores again! The Junior division Represents!!! After 6 years of hard hunting (NJ hunters must be 10 years of age or older), Edward finally got his opportunity. We entered the woods in the predawn light, climbed to the crest of the ridge and quietly watched the sunrise. About 7:15 am a pair of Bucks started coming up the ridge along the same path we used. At about 100 Yards the Big dog ‘made’ us and skipped off to the south and dropped below the ridge-line out of our sight.
Instinctively, Edward stood and stalked to our right about 30 yards. I watched as he surveyed the area below trying to re-acquire his target. Within seconds I could tell his eyes had locked onto something as he dropped to his knee and raised his shotgun. Here it comes, I thought. However, seconds passed (like minutes--Editor) as Edward controlled his breathing and took careful aim. POW!!! The report of the Savage 20 Gauge, Rifled Barreled, Bolt Action Shotgun split the crisp morning air.
Instinctively, Edward stood and stalked to our right about 30 yards. I watched as he surveyed the area below trying to re-acquire his target. Within seconds I could tell his eyes had locked onto something as he dropped to his knee and raised his shotgun.
Here it comes, I thought. However, seconds passed (like minutes--Editor) as Edward controlled his breathing and took careful aim. POW!!! The report of the Savage 20 Gauge, Rifled Barreled, Bolt Action Shotgun split the crisp morning air.
Immediately, Edward racked another Federal Premium sabot, a ballistic-tipped, boat-tailed 20 gauge slug into the chamber and took aim again. Intently I watched him and waited for the follow up shot. 3 seconds went by,...5,...9,...12,...15,... No shot. I saw my son lower his barrel, and slowly stand up. He continued to look down the hill for a while longer. Finally, he turned and looked back at me over his right shoulder and spoke the words I’ve dreamed for years of hearing him say, “Dad,...I got him!!!”
And he’s a Monster. A very mature 10 point Jersey Buck with twin kicker points between his G2 and G3’s. A rack both tall and wide and symmetrical, with all the character you could ask for.
Given all the years of preparation, practice, and field time; all the early mornings, freezing on the stand. You earned this one Kid. Congratulations Son!!! You really knocked it out of the park. That shot was over 120 yards, and you made it count. Perfect execution. I could not be more proud.
Few people will understand or appreciate how difficult and rare an accomplishment it is to harvest a mature whitetail deer, the “most elusive game animal in North America.” But we do. Well done Edward. You have now joined a Brotherhood. May this experience ignite the passion in you for the rest of your life."
EDITOR's NOTE: Scott Costine of Rockaway, NJ, taught his 16 year old son Edward to shoot almost as soon as he learned to walk. The pair have been hunting & fishing together for years. A couple years ago the duo each hunted their own hog at our annual Spring Hog Hunt. We've watched Edward stalk & make a near-impossible shot on a hog through extremely dense brush by being VERY patient. Last summer the father & son joined us at our annual Sporting Clays match at Lehigh Valley Sporting Clays which raised funds for the Mark Cheeseman amicus brief. Why Don’t “They” Do Something?
YOU! Yes, you. You are to blame for the slow, yet constant encroachment of the gun-grabbers. I used to be like you. I used to sit back from the comfort of my home, give $25 here and there to various gun groups then complain that the NRA or whichever organization wasn’t doing enough to protect my rights. What have you done to make sure your rights are protected?
Several years ago I attended an event held by the Coalition of New Jersey Firearm Owners (CNJFO.) After the event I was talking to David Rosenthal about some ideas I had that THEY should do. Rosey looked at me and said, “you should do that.” It hit me like a ton of bricks. Yes. Why don’t I do that? Why am I expecting a handful of people in a state with supposedly a million gun owners to do all of the heavy lifting?
There are too many people out there for one reason or another that do not get physically involved in things like rallies, events, membership drives, or elections. Whether it is out of fear of alienating family members, worrying about having your picture taken at a rally, or just plain laziness, people don’t show up in the numbers that they should. But just throwing money at an issue or sharing memes on Facebook isn’t going to help.
At the special session in Richmond, Virginia back in July, 2019, hundreds of Second Amendment supporters showed up from all over the state to protest the proposed laws. Meanwhile, the anti-gun crowd bused in thousands of people who chanted at us and screamed in our faces. There should have been thousands of Second Amendment supporters attending. Where were you? At the Second Amendment Rally in November, 2019, about two thousand people showed up when there should have been tens of thousands. Where were you?
If ten percent of all firearm owners took an hour a week to get involved in something to help the cause, there would be no asking “Why don’t they do something?” You would become the “they.” We would be a force of great numbers that could not be ignored. It would allow the heavy lifters of the community to be Generals leading an army of Second Amendment supporters.
If you feel the need to defend yourself from anything I've said, you're not doing enough. Get involved. Pick an organization and volunteer some time. Write to your politicians. Get out and vote. All of our voices in unison will be impossible to ignore.

The uninformed NJ electorate, often busy working more than one job to make ends meet, simply doesn't have the time or the skill sets to fully grasp the far- reaching effects of this "feel-good" legislation already signed into law. A massive public relations effort is needed to inform the public of the inherent dangers of Red Flags.

Learning to "PEW" was never more fun than at yesterday's CNJFO Youth Day at the Range as (20) boys & girls ages 8-16 were given classroom gun safety instruction by Coalition Life Member Rocco LaRocca from R.O.C. Training, then fed a catered luncheon prior to .22 caliber live-fire at RTSP's Union, NJ range. Keystone Manufacturing graciously donated several of their single-shot Cricket rifles to us so we can better reinforce the basic safety rules for our young first-timers. Every child proved competency on a Cricket before being allowed to shoot a "repeater", a winning formula to be sure!
Chaired by Eric Saperstein and conducted by CNJFO trustees, members and expert volunteers from throughout NJ & PA., our second youth shooting event this year featured a one-to-one student/instructor ratio, a handsome RTSP swag bag loaded with goodies for each young shooter, customized CNJFO event t-shirt, a sheet cake & cookie assortment for dessert, and a prize table with numerous gun related gifts from our generous sponsors.
CNJFO wishes to thank the parents for their faith and trust in our firearms education & safety program, for without you supplying our students, the event wouldn't happen. Fulfillment of the Coalition's mission statement of firearms education & training wouldn't be possible without the outpouring of support from our dedicated all-volunteer staff.
