    It’s patently simple, in times of crisis, people want to feel protected, unfortunately for some, they have done little to prepare themselves for such situations as evidenced by the runs on basic household commodities at local general stores. Apparently the same band of Johnny-Come-Lately, along with the Moms Demand "Karens seeking the Manager", have now found themselves without a means to defend themselves effectively and have finally awoken to the reality of Warren v. DC where the police do not owe a specific duty to provide police services to individual citizens.

    Johnny & Karen – who formerly eschewed such draconian means of self defense as firearms, upon seeing an apparent breakdown in society from an attacker smaller than a no-see-um, has decided that they shall not be a Star Trek Mom’s Demand Red Shirt (Red Shirted security personnel always first to die on Star Trek "away mission"--Ed.) and will NOW run to the gun store similar to their run to the supermarket for Mr. Whipple’s favorite (toilet paper--Ed) roll, only to find that the laws that Johnny & Karen so righteously touted AND VOTED FOR are now causing them great discomfort.

    That’s right Johnny & Karen, you have to beg the government for a permit. Yes, it requires fingerprints – oh sorry, that’s not available during social distancing. On top of that Johnny & Karen, were you to actually get your fingerprints done, your town, on its own, being purple or blue, have decided that their time is better spent responding to the CoViD than spent processing your background check THAT YOU VOTED FOR.

    Imagine Johnny & Karen’s shock when they find out that even if their rights were processed, they would still be waiting at least 30 days, or if the Sam Browne Belt and blue wool attired crew is involved, markedly more (NJSP Barracks in rural NJ are known to take MONTHS).

    So Johnny& Karen FINALLY get their piece of paper that says “Johnny & Karen are good boys and girls and may pass Go”. Johnny & Karen return to their local gun store SEEKING THE MANAGER only to find out that Johnny & Karen’s friend Mr. Ed (NJ Gov. Murphy--Ed.) has decreed that gun stores are “non-essential businesses” AND has TURNED-OFF the BACKGROUND CHECK SYSTEM touted by Johnny and THE KARENS seeking the Manager...

    That’s OK Johnny & Karen, when your friend (Mr. Ed the Governor) finally decrees that today’s crisis is over (maybe never?) then you can proceed to the gun store to select your firearm, and get your “instant” background check that at last count was 1,000 applications behind, stranding all of last Friday & Saturday's sales with a COMPLETE SHUTDOWN of the NJ NICS portal! That's right, the guy you voted for has now through his (unconstitutional?) Executive Order, CLOSED the background check system through which the special NJ NICS port functions, thereby eliminating the only LEGAL way to transfer a firearm in NJ. Previously long guns could be transferred between adults if the Transferee (receiver of long gun) had a NJFPID card and an ID that matched.

    But don't worry Johnny & Karen, it should only take you about 48 more hours of NEEDLESS WAITING to get your self defense smoke pole when & IF Mr. Ed considers your right to protect your family "ESSENTIAL"!

    Johnny & Karen will get to be armed at that point, from the grave. Cause Marky the Miscreant Doper just got let out of JAIL and came by Johnny & Karen's place and TOOK THEM OUT to get Johnny & Karen's stash of Mr. Whipple’s finest.

    It ain’t a fable folks, it’s JUST NJ.

    In a telephone interview this afternoon with CNJFO, Pitera stated that he researched ways to keep his business open, so that he can continue to provide for his family. This new business approach keeps business flowing and meets the ammunition needs of the Second Amendment community. After researching the limitations of Governor Phil Murphy’s Executive Order 107, Pitera determined that deliveries and online orders are permitted, even though brick and mortar stores are to remain closed.

    If someone is purchasing handgun ammunition, they must provide a driver’s license and a NJ FID firearms purchase ID card, as required per law. Pitera verifies and logs the information though the truck window, making no person-to-person contact in this time of social distancing.

    Call the store number 732-425-4996. Pitera stated that while he has excellent contacts with the ammunition industry, there are LIMITED QUANTITIES at this time. Your needs and availability can be discussed when you contact the store landline, 732-425-4996, now forwarded to his cell.

    *BREAKING* “ANJRPC PREPARING MAJOR LAWSUIT AS GOVERNOR MURPHY UNILATERALLY SHUTS DOWN NJ GUN STORES, NICS SYSTEM, AND RANGES

    People Need Self-Defense Rights When They are Most Vulnerable

    State Government Has No Legal Authority to Suspend 2A Rights

    Governor Should Have Applied “Social Distancing” Measures (as He Has Elsewhere) Instead of Shutting Down the Means by Which People Obtain and Train With Firearms

    On Saturday, March 21, 2020, N.J. Governor Phil Murphy issued Executive Order 107 amidst the Coronavirus crisis, shuttering all “non-essential” businesses until further notice.

    Although the Executive Order does not specifically discuss gun stores or ranges, it applies to all businesses except those specifically exempted, and gun stores and ranges are not listed as exempt (ironically, certain non-essential sellers are exempted while gun sellers aren’t). Additionally, we have received specific “clarification” from the Governor’s office that:

    1. Gun stores are not deemed “essential” and are therefore ordered closed (shutting off the flow of firearms and ammunition to honest citizens, who may need them in times of emergency);

    2. The National Instant Check System in NJ (NICS) for processing all firearms and ammunition transactions has been shut down completely; and

    3. All ranges (indoor and outdoor, public and private) are ordered closed under a restriction on “recreational activities” (is developing proficiency to defend your life really just “recreation?”).

    Thus, two major parts of the Second Amendment (means of firearms acquisition, and means of developing firearms proficiency) have been shut down completely, without an end date, by a single government official, by executive fiat. Social distancing protocols, utilized elsewhere to justify keeping certain other supposedly “essential” businesses open, are not even part of the equation when it comes to firearms, ammunition, and ranges.

    While ANJRPC continues to dialogue with the Governor’s office over this dramatic and unprecedented overreach, we are not optimistic about changing it through discussion.

    Accordingly, ANJRPC is proceeding with rapid development of a major lawsuit to address these unconstitutional measures and to take Governor Murphy (and others in the executive branch of government) to task for overreaching and essentially suspending Second Amendment rights, at a time of emergency when those rights may be needed most for self-protection by the most vulnerable in society.

    ANJRPC is also pursuing, at the federal government level, potential proposals that will incentivize states to protect Second Amendment rights in times of emergency instead of undermining them.

    Gun rights exist precisely for emergencies like the one the country is facing right now with the Coronavirus. Honest citizens must be able to defend themselves and their families from all manner of threats in this type of emergency – not be blocked from exercising their Constitutionally guaranteed rights. A health emergency may not be used as an excuse to suspend access to firearms and training for self-protection, especially when social distancing practices could have easily been applied to ranges and gun stores instead to keep them open (as they have been applied elsewhere). Failure to do so is an abuse of power, a violation of oath, a violation of the Second Amendment, and puts the public at risk. ANJRPC will spare no effort or expense to challenge this Executive Order and to hold those responsible for it fully accountable for their unconstitutional actions and overreach.”

    If you waited to apply for a gun permit (new applicant) or waited to use a hand gun permit to purchase until yesterday or today, or you have a blank hand gun permit you haven't used yet, or have a firearm on layaway or consignment, you're S.O.L.! The New Jersey State Police NICS processing portal is SHUT DOWN UNTIL FURTHER NOTICE! Without the portal, gun dealers in NJ can't get a background check, since there's no legal way around the backlogged, overworked, and now CLOSED NICS Unit! Will our state or national NRA sue on our behalf? Wait & see!

    DISMAYED 1ST TIMERS LEARN THE HARD WAY!

    Many who have never considered firearms ownership - and even many who have previously railed against the right to do so, full of misinformation - are now worried about what may come, and are just beginning to feel the desire to “be prepared”... to plan for the defense of their loved ones and properties... Just in case.

    They are finding, as they walk into a local gun shop, that buying a gun isn’t as easy as they had been told. Lots of folks, some of whom are former anti-gunners, are just NOW trying to buy their first gun. Armed with a headful of misinformation & propaganda about the ease of mail-order acquisition, GUN SHOW LOOPHOLES (that NEVER existed) and the like, utter frustration sets in as FFL's like Legacy Indoor Range & Armory's Melissa Deeney and Andrew Proctor patiently walk their new prospective customer through "THE PROCESS". Their Cinnaminson, NJ store had a line of customers form yesterday before they could put the key in the lock to open!

    NICS (the NJ portal of the National INSTANT Criminal Background Check System) backlog is several days deep and festering with no end in sight, reminding us of conditions post Hurricane Sandy, and everyone that enters Legacy is told:

    “Just so you know, there is a longer than usual queue for the NICS check... We have a line, and NICS has a bigger line. You won’t leave with something today... Do you have your Firearms ID ready to begin the process? Your purchase permit?”

    A SMILE TURNS INTO A LOOK OF HOPELESSNESS!:

    “No. What are those? I didn’t know I needed anything special... How do I get them?”
    “You can apply for both at the same time, but you’ll have to go to your local PD and get the forms. You’ll need to fill them out, pay the fee, get fingerprinted, and then await the determination of your background check and references. It’s not supposed to take longer than 30 days, but it often does take longer.”
    “But with everything going on, I want to be able to protect my family NOW! I thought I could just come in and buy a gun like they say on the news.”
    “I’m sorry - those are the processes and rules every NJ firearm owner has had to follow for years. We can give you information, but we cannot sell you a gun.”

    NJ people are surprised to realize that they have no way to even think about protecting themselves. One lady even said “so what do you have here that I can protect myself with?” And my answer was hair spray and a lighter. ---Melissa Deeney

    When reached for comment, Legacy's Proctor & Deeney added, "They can’t buy firearms because they don’t have FID's (NJ Firearms Purchaser ID cards) and/or pistol permits (every pistol requires its own 4-part permit signed by the local Police Chief). They can’t get FID's because the PDs are closed to public. Even if they COULD get an FID / Permit - they can’t pick them up because the stations are closed to public".

    This tells us at CNJFO that the work ANJRPC is doing to keep the permitting process up & running is truly needed (see yesterday's story Part Four w/ image of "DENIED" on our "Charlie-the-Perp" t-shirt)!

    WHO TOOK ALL YOUR RIGHTS AWAY?

    EDITOR's NOTE: This is Part Four of an ongoing series highlighting what happens to gun rights during a declared emergency. We anticipated additional township administrations to limit or outright deny access to obtain firearms applications & permits. Some administrations consider firearms permitting to be NON-ESSENTIAL, thus denying NJ residents their 2nd Amendment rights. We were proven correct. What follows was posted on the ANJRPC Facebook page this afternoon:

    "ANJRPC has so far received and followed up on leads in 10 different NJ towns. There undoubtedly will be more. Of the 10 leads we have received so far, 5 have been fully resolved, 1 has been resolved in principle but is still awaiting town website update, and 4 towns have been contacted by our counsel and we are awaiting responses.

    We have not yet encountered one town that has flat-out refused to rescind a permitting shutdown when presented with the facts and the law (so far the shutdowns have been in the context of larger reductions in "non-essential" police services). Should we encounter any towns taking that position, we are prepared to promptly engage them in court if necessary. We intend to publicize the identities of any towns affirmatively refusing to process firearms permits after being contacted by our counsel.

    We continue to ask that anyone becoming aware of towns refusing to accept or process new or existing permit applications promptly contact us at strikeforce@anjrpc.org so we can follow up with those towns.

    Please stay safe during this challenging time, and know that ANJRPC will continue to be vigilant in protecting our Second Amendment rights no matter what.

    Part Three of a Series: WHO TOOK ALL YOUR RIGHTS AWAY?

    As some of the most infringed gun owners in the country, New Jersey gun owners are starting to see that the COV -19 situation will be used as an excuse by towns to delay, and deny access to the firearms permitting process. We have already seen that the City of New Brunswick has advised they will no longer process the required paperwork.

    Thankfully, ANJRPC (NJ's state NRA Association) has issued a stern warning to municipalities that this will not be tolerated!     James Madison is quoted as saying “crisis is the rallying cry of the tyrant. “ Emergency situations are ripe for abuse of power. What is most dangerous here in New Jersey is that the entire permitting scheme itself, over a half-century in the making, is a systemic abuse of power, even without an emergency situation. This COV-19 situation has the potential to be as devastating to liberty as throwing gasoline onto a raging fire.

    In New Jersey, when it comes to firearms ownership, we have been warned by our own courts that we “own a firearm at our own peril.” See STATE OF N.J. V. JOSEPH PELLETERI (1996). What statement could possibly contradict “shall not be infringed“ more squarely?

    We do own firearms at our own peril in New Jersey, as we never know what steps the overreaching state government will take next. One does not even need to use the imagination, but merely recall what happened to gun owners during hurricane Katrina: confiscation! The government kicked the 2nd Amendment to the curb and CONFISCATED lawfully owned firearms from innocent civilians at gunpoint. Those firearms were ILLEGALLY confiscated, no receipts were given, and many were never returned to the rightful owners.

    If the towns can no longer process firearms paperwork as required by state statute, then perhaps they need not enforce the entire permitting scheme altogether, thereby providing New Jersey gun owners Constitutional carry. Dare I say, in New Jersey that is much less likely to happen than confiscation at gunpoint.

    Part Two of a Series: WHO TOOK ALL YOUR RIGHTS AWAY?

    New Brunswick, NJ is in the spotlight today, for it is the only municipality in the state of New Jersey to declare itself as devoid of the 2nd Amendment! In an age where pushback from us serfs has resulted in 2nd Amendment Sanctuary counties and towns springing up all throughout New Jersey, the Middlesex County seat has decided, wholly upon its own authority, to cease handling firearms permit applications INDEFINATELY! Yes it's UNCONSTITUTIONAL in a half-dozen ways, especially considering they're still processing applications for Handicapped Parking permits!

    CNJFO President Dan Grdovic when reached for comment earlier today had this to say,

    "It's clear that New Brunswick has determined that you don't need the right to defend yourself, as our elected upper tier consider this a privilege. Certainly legal firearms ownership is much less important than your "right" to park close to the door at every establishment". Grdovic also added, "This is a willful violation of the 2nd Amendment and should be dealt with in the strongest of terms".
